A former Lackawanna Trail High School English teacher was scheduled for a jury trial on assault charges in the Wyoming County Court of Common Pleas Monday, but struck a plea agreement with assistant district attorney Jeff Idec.

Michael William Petherick, 38, of Shickshinny, who pleaded in July to a pair of misdemeanors had that plea vacated after President Judge Russell Shurtleft saw a pre-sentencing investigation in September which revealed significant injuries to the alleged victim, identified as a girlfriend, Marly Scott.

Judge Shurleff said then, “This court is unable and unwilling to accept the plea agreement submitted in this case, and it is hereby vacated.” He ordered Petherick to stand trial Oct. 20.

Petherick was in the court Monday with a new guilty plea for aggravated assault, a felony.

Senior Judge Brendan Vanston accepted the plea and then agreed to an immediate sentence of 9-23.5 months in county jail and a $500 fine. He was taken into custody.

According to court documents, Tunkhannock Twp. police responded to a domestic disturbance at the woman’s Falls’ residence on May 19, 2013, after she called the Wyoming County Communications Center and complained that she was hit by her boyfriend and was bleeding from her eye and ear.

At a magistrate’s hearing more than a year ago, the victim testified that she had been treated at a local hospital for a shattered orbital socket around her eye and displaced nose and cheekbone.

Two weeks ago, Petherick had submitted a formal resignation to the Lackawanna Trail School District which was accepted unanimously by the school board last Tuesday (Oct. 14).

OTHER SENTENCINGS

A number of sentences were handed down by President Judge Russell Shurtleff in the Wyoming County Court of Common Pleas last Wednesday, Oct. 15:

*Robert William Anderson, 43, of Factoryville, was sentenced to a fine of $300 for possession of drug paraphernalia on June 23.

*Brandy Lin Demchak, 35, of Tunkhannock, was sentenced to 18 months probation and a $1,000 fine for simple assault on Dec. 31, 2013.

Ronald George Donnora, 43, of Tunkhannock, was sentenced to 16-60 months in state prison, and a $500 fine for retail theft on May 3. Sentence to be suspended so can enter two years of Luzerne County Treatment Court.

*Edward Lee Engelman Jr., 34, of Harveys Lake, was sentenced to a $500 fine for possession of drug paraphernalia on Aug. 17, 2013.

Chastity Lynn Finch, 44, of Meoopany, was sentenced to 12 months probation, $120 restitution and a $750 fine for criminal use of a communication facility on Jan. 23.

Royce James Hutchinson, 22, of Meshoppen was sentenced to 126 days-12 months in county jail and $7,807 in restitution for theft by unlawful taking on March 6, 2013.

*John Charles Karschner, 28, of Meshoppen, was sentenced to 69 days-12 months in county jail, $569 restitution and a $500 fine for criminal mischief on Sept. 8, 2013.

*Richard Michael Lloyd, 26, of Dalton was sentenced to 22 days-6 months in county jail and a $1,500 fine for DUI on June 6, 2012.

Michael P. Markovitch, 66, of Mehoopany, was sentenced to six months standard intermediate punishment commencing with 30 days house arrest and a $1,000 fine for DUI, second offense, on March 7.

*Julia Arlene Mead, 25, of Nicholson, was sentenced to 12 months probation for criminal conspiracy to commit theft by deception on Nov. 18, 2012.

*Stephanie Miller, 19, of Factoryville, was sentenced to 12 months probation, $400 restitution, and a $500 fine for theft by unlawful taking on May 2, 2012.

*Cody Louis Odell, 24, of Wyalusing, was sentenced to 72 hours-6 months in county jail and a $1,500 fine for DUI on Aug. 25, 2013.

Sandy B. Parkhurst, 53, of Tunkhannock, was sentenced to 4-12 months in county jail for simple assault on Feb. 20.

*Benjamin Ward Pherreigo, 30, of Scranton, was sentenced to 16-48 months in state prison and a $2,500 fine for DUI, third offense, on Jan. 18.

*Michael Keith Rose, 24, of Woodland, was sentenced to six months to five years in county jail, $1,390 restitution and a $2,500 fine for DUI, second offense on Jan. 18.

*Todd Slater, 32, of Nicholson, was sentenced to 16 days-12 months in county jail and a $500 fine for disorderly conduct on May 4, 2013.

*Joseph Francis Trapani, 55, of Dushore, was sentenced to six months probation for DUI on May 23, 2012; and to 12 months probation and a $500 fine for disorderly conduct on May 23, 2012, with sentences to be served concurrently.

*Mark Lee Wilson, 23, of Monroe Twp., was sentenced to 39 days-6 months in county jail and a $500 fine for DUI on April 14, 2013.
